Coach Creed — Spotter Terms

These Spotter Terms ("Spotter Terms") apply when you use a Coach Creed spotter session link (coachcreed.ai/spot/...) to record or upload a video on behalf of a Coach Creed member ("Lifter"). They are an addendum to our Terms of Service and Privacy Policy. If anything conflicts, these Spotter Terms control for spotter upload activities.

By checking the agreement box and uploading a video, you accept these Spotter Terms.

1. Eligibility

• You must be 18 years of age or older.
• You must have the Lifter's permission to record them for this session.
• You may not use the spotter link to record anyone who has not agreed to be filmed.

2. What You Are Agreeing To

You understand that:

• The Lifter initiated this session and invited you via a time-limited link.
• Your video will be transmitted to Coach Creed's servers in the United States.
• Coach Creed will process the video using automated tools (including pose estimation and artificial intelligence) to generate form feedback for the Lifter.
• You will not receive form analysis results, workout data, or access to the Lifter's account.
• The link expires after a short period (typically 2 hours).

3. License You Grant

You grant Hey Creed LLC and the Lifter a worldwide, non-exclusive, royalty-free license to:

• Store, reproduce, transcode, and process your uploaded video for this Form Check session.
• Combine your video with the Lifter's primary video for display and AI coaching output to the Lifter.
• Extract movement metrics and observations from your video using automated analysis.

This license is limited to the spotter session associated with the link you used. It does not grant the Lifter or Hey Creed LLC the right to use your video for unrelated purposes, marketing, or public distribution without separate consent.

4. Your Representations

You represent and warrant that:

• You captured the video yourself or have the legal right to upload it.
• The Lifter consented to being recorded in this session.
• Your recording complies with applicable law and any gym or facility rules that apply to you.
• You will not upload content that is unlawful, harassing, sexually explicit, or infringing.

5. Privacy and Deletion

• Coach Creed's Privacy Policy describes how we handle spotter uploads.
• The Lifter may delete session videos from their account; deletion removes associated spotter footage linked to that session.
• Spotters without an account may contact privacy@coachcreed.ai to request deletion if they provide the session link or approximate upload time.

6. No Employment; No Physical Spotting Duty

• You are not an employee, contractor, or agent of Hey Creed LLC.
• "Spotter" in the product name refers to camera assistance, not physical barbell spotting.
• Hey Creed LLC does not supervise your actions in the gym. You are responsible for your own safety and conduct.

7. Disclaimers

• Coach Creed provides AI-generated fitness information, not medical advice.
• AI analysis may be inaccurate. It is not a substitute for a qualified trainer or healthcare provider.
• THE SPOTTER WEB PAGE AND UPLOAD FLOW ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

8. Limitation of Liability

To the maximum extent permitted by law, Hey Creed LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the spotter upload flow. Our total liability for any claim related to a spotter session shall not exceed fifty U.S. dollars (US $50).

9. Indemnification

You agree to indemnify and hold harmless Hey Creed LLC from claims arising from your recording or upload, including claims that you recorded someone without permission or violated venue rules.

10. Governing Law

These Spotter Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules, except where mandatory consumer protection law in your jurisdiction applies.
